Almost 50 percent of builders do not hand over the deemed conveyance. She added that even after a person purchases a flat / apartment, the ownership of the land remains with the builder / landowner. Sneha S Joshi, the deputy registrar of co-operative housing societies, told Mirror that only seven documents are now necessary to obtain the deemed conveyance. In Maharashtra, there are 1,20,000 registered co-operative housing societies. Out of these societies, 5,000-7,000 societies are on the verge of redevelopment. Out of the 18,000 housing societies in Pune district, 65 percent have not got the deemed conveyance till date. Now, with the deemed conveyance, housing societies will be able to get their name registered in the 7/12 extract / property card, without any encumbrance or delay.

This has compelled the registrar to intervene and initiate the special campaign. Also, it terminates developers’ rights to the ownership of the land.Īnother focus of this drive is to ensure that the responsibility of the developer / builder to complete the deemed conveyance formalities within the stipulated timeline is adhered to, which they have failed to do so in countless instances.

With the deemed conveyance, Societies now get ownership of the land. Hence, the could not proceed with redevelopment projects and obtaining extra FSI. One of the reasons for this special campaign is housing societies do not have the deemed conveyance. The commissioner has appealed to all concerned stakeholders, namely housing society members and officebearers (managing committee members), to register themselves area-wise for this campaign at the office of the registrar of the co-operative housing societies.Īll builders / developers have been directed by the commissioner to hand over buildings to respective housing societies as per the Cooperative Societies Act, as soon as the construction is complete in all aspects. The commissioner of co-operative housing societies recently instructed all offices and office-bearers to expedite simplifying the process of deemed conveyance by starting a special campaign, which commenced this week. Under section 11 of Maharashtra Ownership Flats Act 1963 (MOFA), the builder / landowner must convey the title to a housing society within four months of its formation.
